after buying this I have found that this model is being discontinued and am concerned that after speaking to Samsung's technical support about the probs I am having with the phone they said there is a fault on the phone's software. The retailer is very reluctant to exchange it saying there will probably be a fault on the whole of the batch, and basically I should put up and shut up. Anyone else had probs with theirs plse?

If the equipment sold, is not fit for what it is intended for, ie in your case a software problem, then it is up to the retailer to rectify the problem as he/she sold it to you as working correctly. If they won't, then ask for a full CASH/C-CARD refund.
