Royalty free music for website

Hey guys,

I'm from Australia and I was wanting to put about 20 seconds of music on my website but I would suspect I can't just put any old music file I want on there and that there are all kinds of legal issues because this is a small business website I am making. Now so my search begins for royalty free music that I can put a bit of on my site but so far I have had no luck finding any. Would anyone know of any place that I can get free music to use on my site without getting sued? I have come across these old songs from like the 1950's-60's that have been remade with midi by some people who are giving it out for free. Are there legal issues using these midi's on a website even though the songs have been remixed? And finally.. whats the best way/format to add music to a site.. (Streaming?) and what do I need to do it and how? Anyway forgive me for the barrage of questions just answer whatever you feel like.. any info you guys can give me will help. Thanks in advance guys,

I'm just guessing, but I'd think that even a remixed instrumental version of a piece of music would still infringe the original copyright. Having said that, as long as you weren't offering the music for sale from your site, or on a peer to peer download basis, I doubt that you'd ever have problems. It's unlikely that your site would ever be found by anyone in a position to sue and, in the event that someone did have a problem with your use of their copyrighted music, you'd probably just get a formal warning to remove it to prevent further action.

www.flashkit.com/ have a selection of royalty free sound clips in various formats if you want to be on the safe side

Midi files are frequently used for streaming sounds because they are usually very small file sizes compared to some of the other formats. You could also look at streamed Flash audio produced with Macromedia Flash or a program like SWF Sound Automation Tool.

Heaps of help thanks. :) Not much of a risk I know but I tend to be overy careful about these kinds of things. Thanks for the links and help checking it out now. Should sort it all out. On the copyright issue, you are right to be careful. I made my first Flash movie and included part of a track from an album. I contacted the producers (EMI Europe) as I am real heavy on following copyright and getting permission to use intellectual/artistic works. I was told I should set aside a "large portion of your budget" to cover royaltie payments.

So I have a great movie, and cannot show it at my domain, since my site is non-profit and that would break the budget. As for a remix, depends I think. If you did the mix from scratch from music score, the only issue you would have is with the owner of the score.

Or, alternatively, you can get away with using the score as the basis for a new work, with sufficient difference to make it a unique and original piece of your own. That was done for the theme to the Paralympics 2001, and shown all over the TV stations without copyright infringement.

Yeah I like to stay pretty strict on copyright issues myself and find out what I can and can't do without infringing. Thanks for the info. If I can't find anything royalty free that is suitible I'll probably just create something totally original myself or very loosely based on something preexisting then.

I know a lot of midi sites were forced to shut down a couple of years ago because of copyright issues. I think the copyrights were infringed on the arrangements of the midi sequences rsther than the tunes themselves. People were grabbing midis and putting them up for download on their midi sites. So keep this in mind. It may be worth contacting the arranger of the midi sequence to ask permission, although most midis are used in the public domain with out issue.

Another thing to bear in mind about Royalty Free sounds (and images for that matter). You are granted free use (hence the Royalty Free tag) via licence, but that use is usually limited to personal projects with no wider audience than your immedaite family and friends. Placing a sound file on your web page is deemed as broadcasting, which most would see as a breach of the terms of use of the sound file.

Just out of innerest, did you have a perticular piece of music you wanted to use?

Thanks for the reply fat controller,

All I wanted really was anything at all in the early swing genre. I didn't think it would be such an uphill battle with legalities just to get a 20-30 second loop of nothing in particular. Yes this is a small business website so my local commuinity will be the people viewing the site so royalty free music might be a problem then I guess. Grr frustrating. Anyway thanks for the further info guys. Starting to get the picture. :) Logistical legal nightmare got it. :)
