Is this unfair terms and conditions?

I was looking into reducing my BT broadband from option 3 to option 1 has I don't even use anywhere near the maximum for option 1, I only use about 4Gb a month and double that if I try and watch loads of video listen to lots of music, but the connection is that slow it isn't worth bothering with.
I went into the full terms & conditions of BT broadband and they want to charge nearly £40 if you drop from option 3 to either option 2 or 1. Personally I think it is when if you just cut your broadband they only charge £18 (£25 after 12th June)
Then I didn't find anything in the T&C's that said how to actually either upgrade or downgrade the options.

Is that charge at 'any time' or during the contracted period?

It does not state whether it is one or the other so I assume it is any time.

The T & C's quote:
"If you downgrade from BT Total Broadband Option 2 or 3, we may charge you up to £39.14. This charge will be included in your next bill".
It's only a phone call to clarify what the 'may' actually means.
I would expect you'd also have to sign another 12 month contract.
