cancelling a btbroadband contract

Does anyone know just how bad an internet connection has to be to warrant cancelling the contract?
got btbroadband 6 long weeks ago and have had intermittent connection ever since. one day is fine then next it wont connect for more than 10 mins without router dropping line.

bt insist on sending an engineer to check but if it works on the day they come then they will want to bill me.
had a long conversation with bt today where they repeatedly insisted that i had a 1 year contract to honour but surely if it does not work properly i am not obliged to continue?

In general terms if the goods or services are not as described then you have the right to cancel and get your money back. However you must also allow the supplier to attempt to rectify the fault. In this case that means allowing a BT engineer to check the line. If the line is fine then BT are quite within their rights to expect you to continue paying for the service. Simply cancelling your standing order or direct debit will see you in court facing a hefty fine and an order to pay BT everything you owe them.

yes, I had a long chat with bt people about this. My point is that it is an intermittent problem. Maybe the engineer will come on a good day and the line will be fine but then it fails again after they leave?

how can I possible prove an intermittent fault?

and, looking at the sale of goods act on dti it says ...
If goods do not conform to contract at the time of sale, purchasers can request their money back "within a reasonable time". (This is not defined and will depend on circumstances)
it also says you may request a repair - it does not seem to say that you must allow a repair?

You do not say how 'far away' you are from the exchange, we had a problem with a bt adsl user, the problem was with the modem thing bt supplied, reloading the drivers resolved the issue, they had to do that once a month on windows xp and that kept him trouble free after that.

If you want to cancel bt (?yahoo?) broadband, expect to spend 30 minutes on the telephone (and be nice, the last person you speak to actually knows what there talikng about rather than somebody in India who just 'suggest you disconnect ypur computer and pc for half an hour' and turn it all back on again).

He migrated from BT after 12 months.
