Hi I have Tiscali at the moment and I am a heavy downloader. They have emailed me once to warn me about my usage during peak hours (Mon-Fri 6 to 11pm and Week end from 12 to 4pm). I really was not aware of this when I signe dup with them and now I have been issued with a final warning and if i do not comply they will mamange my speed during peak hours. This really sucks!!!. So i want to know if any of you can recommend an ISP where no fair usage policy is applied. Looking for 2mb up and a reasonable price Thanks!

have a look here, 1 ISP I think that will not restrict you is AOL, but then maybe they do have limits but set it high enough for you. The only problem is how much RAM you need to run the latest AOL software as every time they bought out another version it would need more RAM to run the last I knew it was 128mb RAM for version 7 or 8

I hope you was sarcastic back to that warning email they sent . I wouldnt have none of it - I mean your paying for the service and if they have silly limits imposed then there service isnt up to scratch.

Unfortunately, most domestic rated, unlimited ISP's have a 'fair usage' policy in place - check the small print.

Not at all, first warning came on 22/11 and the latest one on the 25/11...3 days later and they even had to refund me a month cos there was a problem with the line and they took 3 and a half weeks to sort it out.
I will cancel as soon as I can get through to them, they are useless. Any comments?

Dear Customer, Further to the recent email regarding heavy usage; your broadband Internet usage has again been highlighted as exceptionally high during peak periods and is affecting the service we provide to other customers.
Please carefully read the following email to avoid any further warnings. This is your final warning, if you do not reduce your usage during the peak periods we will manage your service during the peak hours.
Please ensure read our Fair Use Policy (http://www.tiscali.co.uk/fup) so you are clear on your obligations with regards to internet use during the peak hours.
You may upload and download as you wish outside the peak hours; but we ask that you are considerate when using the internet during the peak period. Peak hours are from 6pm to 11pm on weekdays and 12pm until 4pm on weekends. To avoid any further heavy use warnings we strongly recommend you adhere to the following guidelines:
o) Do not download large files during the peak periods
o) Do not use Peer-to-Peer file sharing software during peak periods (e.g. Kazaa, BitTorrent)
o) Try and keep internet use to email and web browsing during these times.
If you do not reduce your usage during these peak times (6pm to 11pm weekdays and 12pm to 4pm weekends) we will manage your usage. This means that you will share bandwidth with other heavy users during peak times instead of sharing bandwidth with normal users. Your service will continue to be unlimited, but by sharing bandwidth with other heavy users you are likely to experience slower speeds during peak times.

Seems perfectly fair to me. Your heavy use of the system is affecting other users so they will lump you in with all the other heavy users. They are still offering you an uncapped service, just slower. Why should your surfing habits impinge on others who wish to use the service in a less intensive way?

I use AOL but have migrated due to there steath limit. I'm on online gamer and file share maps and other such things to make a game more popular. After a few months my AOL software needed to be updated. I didnt have a problem with the version i was using, but i updated anyway, as soon as i did my internet connection was dropped after a few hours everytime i was sharing maps. I removed the AOL software but the update was automatic and crippled me. Never the less i've moved to another ISP, lets hope this new ISP can see that i'm paying for a service that i want and need and dont steath limit me. I will try and post an ISP compasion page when i remember where i put it. http://www.adslguide.org.uk/

In a way, you are lucky that they warned you that they would 'manage' your service, talktalk just go ahead and throttle, last year from 4 pm to 12 pm, now 24/7. I have taken it up with trading standards on the basis of unfair contracts. Will keep forum updated but roll on 29th March when I will move to another ISP who won't throttle, charge 50p a minute for you to tell them that their connection is faulty, etc.

The only time I was made aware of this was when they sent me a letter through the post, on checking my tiscali email account, I found they had sent me three FUP warnings. And I was put on this restricting thing. I am annoyed that they can still claim unlimted service after this. I mean there FUP is rubbish, it doesn;t tell you how much is unfair usage. It's like giving you a car without a speedometer, how do you know if your going to fast?
Well anyway I got over this annoyance, but it didnt stop there now I get stupid amounts of packet loss all the time. I can't play any games, I can't use teamspeak, I can't use xfire. Basically the only 3 things I do on the net I cant do because of up to 90% packet loss. So I can download at normal rates, something they don't like. But I can't do any of the things I normally do. (BTW don't ask me how I get 90% packet loss but I can still download at 60-90kbs)

I have been with Tiscali less than a month and have already recieved two FUP warnings. It's a bit silly. I download a lot, sure, but overnight, not between the hours of 6 and 11, and I certainly don't download nearly as much as some people out there. The only thing I can put the warnings down to is online gaming between those hours, namely, Unreal Tournament 2004.
The game itself doesn't use up a huge deal of bandwidth, and it certainly never exceeded the FUP of my previous two ISPs. The only thing that might push the bandwidth is the downloading of new maps and files mid-game, but even then, maps are usually, at the most, 20mb.
Is 20mb really "exessively high" usage for a broadband connection?
I love the speed that Tiscali provides, but if they continue to be this unfair, i'm gonna have to drop the contract with them and shop around. It'll be worth the early cancellation fee to get a fair connection.
